I don't see why not. It is simply a more organized form of the 'you don't pay if you don't win' firms.
It is simply a buisness investment, and as long as there isn't a conflict of interest I don't see how there could be a problem.
An entirly different question is: is this moral?
But that is outside the scope of most buisness decisions (or at least a disturbing large ammount of them anyway).
