What I see here is an attempt by the police department to save face. Unfortunatly, they didnt take the best option, which would have been to apologise to the guy.
That would have been worth maybe 1" of copy.
Even assuming they dont follow through on any other charges, which I can totally see them trying to do in an attempt to save some face, this has netted them a lot more of the type of publicity they DONT need. And it will only get worse if they do, in fact, try and find some charge to hang on this poor guy to justify themselves.
by the time this is over, the'll have garnerd themselves a good foot, foot and a half of copy full of how idiotic they are.
