If you follow the order in the Talmud or the usual lists of the Orthodox churches, sure. If you follow the Catholic or Lutheran order, "Thou shalt not kill" is #5. And if you follow the Augustinian order, it's #3 and combined with "Thou shalt not commit adultery" (and there's only seven Commandments).
